CMC stuck with garbage - a response With reference to our news item titled 'CMC stuck with garbage' that appeared in our issue last Sunday, Burns Environmental and Technologies (Pvt) Ltd. has sent us a press release clarifying their position. It says: "We have entered into an agreement with the Colombo Municipal Council for disposal of garbage for a payment to be made monthly by them. "For several years we have been accepting garbage in the same manner up to March 31, 2005 on payment of the specified fee. However the Colombo Municipal Council (CMC) had defaulted payment starting from the December 1, 2004 amounting to approximately Rs. 36 million up-to-date. "In spite of this default of payment, we have accepted garbage up to the March 31, 2005 to avoid much inconvenience caused to the citizens of Colombo. "While the CMC alleges several violations of the contract on the part of our company, the CMC itself has violated several clauses of the agreement from its inception. This matter has been referred to litigation by both our companies and the Colombo Municipal Council. "In spite of the above violations by the Colombo Municipal Council we had made it clear to them without prejudice to our rights in the aforesaid litigation we are willing to accept garbage subject to settlement of our dues. "All efforts to resolve this problem amicably could not be materialized this time, due to the behaviour of several officials of the Colombo Municipal Council, even though similar situations which arose on previous occasions were settled amicably." |
